The Base Funding Conditions (applying to all on-Plan Funds) require tertiary education organisations (TEOs) to provide learners with specific information about the collection and use of their personal information, and its disclosure to government agencies.

This requirement applies to learners starting the enrolment process from 1 January 2025. TEOs do not need to apply it retrospectively to learners who have already enrolled before that date, regardless of whether their study or training has begun.
TEC template privacy statement
The Tertiary Education Commission (TEC) has created a template privacy statement that reflects the requirements contained in the Base Funding Condition. The privacy statement will also be included in the 2025 generic enrolment form available in the SDR user guides and forms.
Using this template privacy statement gives you assurance that you are meeting the requirements of the Base Funding Condition.

TEOs using their own privacy statement
You may use your own privacy statement but it must include the content of the TEC template privacy statement. We recommend you review any privacy statements you currently use at your TEO, to ensure they comply with the minimum requirements.
If you wish to disclose a learner’s personal information to agencies other than those listed in the TEC template privacy statement, you must ensure you meet the requirements of the Privacy Act 2020 and its principles. This includes advising learners about the collection and use of their personal information, who your TEO may disclose the information to, and for what purpose.
